These Terms & Conditions ("Terms") govern the use of the website einkommensdata.com and all services provided by EinkommensData, Friedrichstraße 112, 10117 Berlin, Germany ("EinkommensData", "we", "us"). By accessing our website, requesting a quote, purchasing a report or subscribing to our data services, you ("Customer" or "User") accept these Terms in full. If you do not agree with any part of these Terms, you must not use our services.
1. Services
EinkommensData provides income data research, market analytics, custom datasets, market potential analyses, data consulting and related reporting services ("Services"). The specific scope, deliverables, update frequency, delivery format and pricing of each Service are defined in the individual offer, order confirmation or subscription agreement concluded between EinkommensData and the Customer. Unless expressly agreed otherwise in writing, such individual agreements take precedence over these Terms.
2. Conclusion of Contract
A contract between EinkommensData and the Customer is concluded when EinkommensData confirms the Customer's order in writing (including by e-mail) or begins providing the ordered Service. Quotations provided by EinkommensData are non-binding and valid for 30 days unless otherwise stated.
3. Prices and Payment
- All prices are quoted in euro (EUR) and, unless stated otherwise, are subject to the applicable statutory value-added tax.
- Invoices are payable within 14 days of the invoice date without deduction, unless a different payment schedule is agreed.
- For subscription services, fees are due in advance for the respective billing period (monthly, quarterly or annually as agreed).
- In the event of late payment, EinkommensData may charge statutory default interest pursuant to Section 288 of the German Civil Code (BGB) and suspend the delivery of data until all outstanding amounts have been settled.
4. Licence and Permitted Use
Upon full payment, the Customer receives a non-exclusive, non-transferable and, unless expressly agreed otherwise, non-sublicensable right to use the delivered data, reports and analyses for its own internal business purposes.
The following is prohibited without the prior written consent of EinkommensData:
- reselling, sublicensing, renting or otherwise commercially redistributing the delivered data or reports to third parties;
- publishing data in a form that allows the reconstruction of substantial parts of the underlying datasets;
- removing, altering or obscuring copyright notices, source attributions or other proprietary markings;
- using automated systems to extract data from this website other than through the officially provided API.
5. Data Sources and Availability
EinkommensData aggregates and processes data from official statistical offices, tax authorities, EU-SILC surveys and other documented sources. All data is anonymized and aggregated in accordance with the GDPR and applicable national statistics laws. While EinkommensData strives to maintain a high accuracy rate and regular update cycles (quarterly for core national datasets, annually for municipal-level data following official releases), the availability and timing of updates depends on the release schedules of the underlying sources.
6. Customer Obligations
The Customer shall provide accurate information necessary for the performance of the Services, use the delivered data only in accordance with these Terms and applicable law, and ensure that access credentials (including API keys) are kept confidential and are not shared with unauthorized third parties.
7. Intellectual Property
All rights, titles and interests in and to the website, the delivered reports, datasets, methodologies, analyses and underlying databases remain the exclusive property of EinkommensData. Nothing in these Terms transfers any ownership rights to the Customer.
8. Warranty and Liability
- EinkommensData warrants that the Services are performed with professional care. Statutory warranty rights under German law apply unless expressly modified in an individual agreement.
- EinkommensData shall be liable without limitation for damage caused by intent or gross negligence, for injury to life, body or health, and in accordance with the German Product Liability Act (Produkthaftungsgesetz).
- In the event of slight negligence, EinkommensData shall only be liable for breach of material contractual obligations (Kardinalpflichten) and limited to the foreseeable damage typical for this type of contract, in any case no more than the fees paid by the Customer in the twelve months preceding the claim.
- Liability for slight negligence regarding obligations other than material contractual obligations is excluded.
- EinkommensData makes no warranty that the data is fit for any particular purpose beyond the agreed scope of Services. The Customer is responsible for validating the suitability of the data for its individual use case.
9. Term and Termination
One-off orders end upon full delivery of the Service. Subscriptions run for the agreed term and renew automatically for the same period unless terminated in writing with 4 weeks' notice before the end of the current term. The right of either party to terminate for cause (e.g. material breach, non-payment, insolvency) remains unaffected. Upon termination, the Customer's right to use the delivered data for new analyses ends; lawfully acquired datasets already in the Customer's possession may be retained for internal use in accordance with Section 4.
10. Data Protection
EinkommensData processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Details on the collection, processing and use of personal data, the legal bases, retention periods and your rights as a data subject are described in our Privacy Policy. 12. Changes to These Terms
EinkommensData may amend these Terms to reflect changes in legislation, technology or its service offering. Customers will be notified of any amendments in text form (including e-mail) at least 4 weeks before they take effect. If the Customer does not object in writing within this period, the amended Terms are deemed accepted. The Customer will be specifically informed of this consequence in the notification.
13. Governing Law and Jurisdiction
These Terms and all contracts concluded on their basis are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Berlin, Germany, provided the Customer is a merchant, a legal entity under public law or a special fund under public law. Mandatory consumer protection provisions, including those on jurisdiction, remain unaffected.
14. Final Provisions
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects its economic intent. The same applies to any gaps in these Terms. Amendments and supplements to these Terms must be made in writing to be effective.
